• Using natural materials for office supplies;
• Prioritising public transport and bike-riding;
• Conscious selection of our partners (i.e. our ecological coffee is delivered by bike);
• Encouraging minimal printing;
• Drinking tap water instead of using plastic bottles.

Although all of us continue to make concrete efforts in this, we have still had a negative overall climate impact, whether we like it or not. Consequently, to measure our climate impact in order to be better able to tackle it, we have carried out an evaluation of our 2019 CO2 emissions in partnership with CO2Logic, a Brussels-based agency offering climate and environmental advice to corporations.

CO2Logic helps us to calculate, reduce, and actively compensate for our local and global climate impact, validated by Vinçotte, an independent international certification body. The CO2Logic team partners with multiple environmental and social projects around the world, whose activities can help to reduce the impact of carbon emissions through offsetting.

In 2019, PI Brussels had 34t CO2 emissions, and the team got together to collectively decide on what project to support. Our 2019 CO2 emissions will be offset in a project that supports farmers in Zambia with agricultural methods that safeguard the forest and improve their livelihood.

Climate change is happening right now, and the consequences are already noticeable across the globe. There is an urgency to do everything we can to limit our carbon emissions.

So, let’s put our words into action and work to collectively reduce our CO2 emissions to make our planet a better place!

The general focus of Bettel II is on economic growth, through the classical recipe of ‘fiscal competitiveness’, but also coupled with a strong focus on digital innovation. The Government will continue to deploy the ‘Third Industrial Revolution (TIR)’ strategy, which was developed in collaboration with the American economist and social theorist Jeremy Rifkin, and adopted in 2016. Counting on the Digital Luxembourg Initiative, the Government aims to create a favourable ecosystem for new innovative start-ups in the ICT sector. This is further showcased by the creation of the ‘Digital Tech Fund’, with a budget of €20 million, to support ICT start-ups and aims to invest in, among others, cybersecurity, fintech, big data and digital health. Luxembourg will also follow through with its ambitious project to become an European space hub. Through the SpaceResources.lu initiative launched in 2016, the Grand Duchy supports space companies, as well as bolstering cyber security, stimulating emerging sectors such as robotics and artificial intelligence.

As in other European countries, climate and energy were high on the agenda in the past months. In late February, Luxembourg submitted its National Energy and Climate Plan 2021-2030 to the European Commission. Minister of Climate Carole Dieschbourg and Minister of Energy Claude Turmes – both Greens – presented an ambitious and comprehensive plan. This features measures such as the phasing out of heating oil and gas in buildings by 2030 in addition to the development of electro-mobility with the support of new premiums. In this regard,  in early March, during the presentation of the Government’s budget, Finance Minister Pierre Gramegna announced the Government’s intention to continue with the increase of tax on fuel products as an environmental measure. Part of the projected additional revenue of 2.5 million€ that the tax will yield will be allocated to the national climate fund.

The Government is also carrying through that environmental focus in its finance policy. Building on the  ‘Sustainable Finance Roadmap’ of October 2018, which laid the foundation for a sustainable finance strategy, Finance Minister Pierre Gramegna has recently hinted the Government could lower the subscription tax for sustainable investments funds, including ‘green funds’.  Opposition Party CSV, sensing that the Government is yet to take concrete actions on this policy stream, took action and proposed a draft bill, which includes among others the creation of a Committee for Sustainable Finance.

In January 2019, the Ministry of Health, in cooperation with the Luxembourg Institute of Health, launched a large survey to assess the current situation of health among the population of Luxembourg. The data will allow the State to assess the results of previous health policies and tailor the health system to citizens’ needs. Furthermore, a law proposal on the creation of the National Health Observatory, aiming at improving the global health of the population and deriving from the WHO ‘Health 2020’ framework, is currently being discussed in Parliament.

In accordance with the ‘red lines’ carved out in the coalition agreement on the topic of social affairs, the Government passed a bill increasing the minimum wage by 100€, retroactively coming into effect on the 1st of July. Included in this raft of legislation, the Parliament also adopted one additional day of leave pertaining to the legal minimum, as well as an additional public holiday on the 9^th of May, the so-called “Day of Europe”. Facing the critics of the National Court of Auditors, arguments have been levelled against the Government that it has thus far failed to react to the urgency of the social housing situation. With a booming population (a 65% increase between 1981-2018), the Government will need to frame a policy on future needs whilst also addressing an average rent-price increase of 44% between 2005 and 2017.

Possibly the most mediatised announcement of the new Government was the decision that public transport will become free from March 2020 onwards. To meet growing demand, a 1.4 billion € investment budget has been allocated to expand and modernise the public transport network over the next four years. Both a social and environmental policy measure, free public transport is also seen as a great opportunity for the country branding of Luxembourg, which will become the first country with entirely free public transportation.

For the next legislature, the Government will also continue the process of constitutional reform begun in 2009, paving the way to a new constitution by 2020. Finally, one of the future measures part of the coalition agreement is the creation of a lobby register in order to increase transparency in the legislative process.

The Gambia coalition of Mr Bettel has undoubtedly shown eagerness in its first months. It now has a good four and a half years to execute the remaining elements of its ambitious agenda. This, however, does not promise to be an easy undertaking. The Government has a narrow one-seat majority in the Luxembourgish Parliament. A first electoral test is also already on the horizon. The upcoming European elections on the 26^th of May will serve as an indicator as to whether voters also believe this Government is on the right track.

Zondag 26 mei, verkiezingsdag, staat sinds lange tijd met rood omcirkeld in menig agenda. Een val van de regering in de komende uren of dagen, zou kunnen betekenen dat niet enkel de politieke partijen, maar ook middenveldorganisaties, sectorfederaties en het bedrijfsleven, hun planning moeten omgooien.

Hieronder hebben we voor u acht scenario’s opgelijst, gerangschikt volgens hun potentiële impact op uw public affairs-strategie.

1. De regering valt niet, er komt een compromis uit de bus

Het is nog altijd niet uitgesloten dat er toch nog een compromis wordt gevonden en premier Michel alsnog op 10 december naar Marrakesh kan afreizen. De mogelijkheid bestaat om met Frankrijk, Nederland en Duitsland een stemverklaring af te spreken waarin staat vermeld dat het VN-migratiepact geen impact zal hebben op het asiel- en migratiebeleid van de individuele lidstaten.

Waarschijnlijkheidsgraad: Het is weinig waarschijnlijk dat N-VA zo een stemverklaring zal aanvaarden. De partij is van mening dat het pact sowieso niet goedgekeurd kan worden

2. De regering valt niet, Theo Francken neemt ontslag

Het zou voor N-VA een uitweg zijn om enerzijds haar protest ten aanzien van het migratiepact zeer duidelijk te signaleren, maar anderzijds niet verantwoordelijk te worden geacht voor het veroorzaken van een val van de regering.

Waarschijnlijkheidsgraad: Geen enkele politieke hoofdrolspeler heeft tot dusver deze optie publiekelijk uitgesproken. Ook Francken zelf heeft zijn persoonlijke toekomst nog niet verbonden aan het migratiepact. Daarom lijkt dit scenario weinig waarschijnlijk.

3. De regering valt niet, het migratiepact wordt goedgekeurd met een wisselmeerderheid

MR, Open VLD en CD&V kunnen samen met partijen uit de oppositie steun verlenen aan het pact via een wisselmeerderheid. In dat geval kan de premier niet naar Marrakesh, want daarvoor is consensus in de regering nodig. Aangezien de premier zijn aanwezigheid in Marrakesh heeft aangekondigd in zijn speech voor de Algemene Vergadering van de VN zou dit evenwel gezichtsverlies betekenen.

Waarschijnlijkheidsgraad: N-VA heeft, bij monde van kamerfractieleider Peter de Roover, laten verstaan dat indien het pact met een wisselmeerderheid wordt goedgekeurd, zij de regering niet langer kunnen steunen. Dit maakt het scenario onwaarschijnlijk

4. De premier biedt zijn ontslag aan, maar de Koning aanvaardt het ontslag niet

Indien de meningsverschillen tussen de regeringspartijen over het migratiepact onoverbrugbaar zijn, rest de eerste minister geen andere keuze dan het ontslag van zijn regering aan de Koning aan te bieden. De Koning kan het ontslag aanvaarden, weigeren of in beraad houden.

Als de Koning het ontslag weigert, behoudt deze regering haar volle bevoegdheden. De Koning kan in dit geval bemiddelaars of verkenners het veld insturen om de crisis te helpen bezweren. Want, in dit scenario moet de crisis over het migratiepact nog altijd opgelost worden.

Waarschijnlijkheidsgraad: N-VA en de rest van de meerderheid staan lijnrecht tegenover elkaar in dit dossier. Het is dus maar de vraag of op enkele maanden van de verkiezingen een oplossing kan worden gevonden en of de premier niet nog eens zijn ontslag zal moeten aanbieden.

5. De regering valt, er komt een minderheidsregering zonder N-VA

Als de Koning het ontslag weigert en N-VA beslist dat ze de meerderheid wil verlaten, kan het migratiepact worden goedgekeurd met een wisselmeerderheid (van MR, Open VLD, CD&V, PS, Groen, Ecolo, Cdh en SP.a).

Na deze stemming blijft mogelijk een minderheidsregering aan de macht waarbij MR, Open VLD en CD&V op zoek zullen moeten gaan naar steun uit de oppositie (inclusief N-VA) om lopende dossiers nog voor 26 mei goedgekeurd te krijgen.

Waarschijnlijkheidsgraad: De andere coalitiepartners zijn mogelijk niet te vinden voor deze oplossing aangezien N-VA in de verkiezingscampagne dan zowel de voordelen van oppositiepartij en coalitiepartner zou kunnen uitspelen. Dit scenario is dus onwaarschijnlijk

6. De regering valt, er komt een nieuwe meerderheid

Als de Koning zijn antwoord in beraad houdt of weigert kan de premier die tijd ook aanwenden om een andere meerderheid op de been proberen te brengen, zonder N-VA.

Waarschijnlijkheidsgraad: Dit scenario wordt doorgaans afgedaan als zeer onwaarschijnlijk. De linkse oppositiepartijen staan niet te springen om de centrumrechtse agenda van Michel I uit te voeren.

7. De Koning aanvaardt het ontslag van de regering maar de Kamer stemt tegen, er komt een regering van lopende zaken

Als de Koning het ontslag aanvaardt, ontbindt hij de Kamer van volksvertegenwoordigers, op voorwaarde dat een meerderheid van de Kamerleden hiermee instemt. Indien de parlementsleden echter tegen stemmen, gaat de regering in “lopende zaken” tot aan de verkiezingen in mei.

Onder “lopende zaken” verstaat men het nemen van spoedeisende maatregelen en het afwikkelen van routine-aangelegenheden. Het begrip “lopende zaken” is gegroeid uit de rechtspraak. Geen enkele formele tekst regelt deze aangelegenheid.

Waarschijnlijkheidsgraad: Moeilijk in te schatten. Enerzijds is de regering maanden in lopende zaken laten zitten voor geen enkele partij aantrekkelijk.  Anderzijds is het niet zeker of er een parlementaire meerderheid te vinden is voor de ontbinding van de Kamer.

8. De Kamer wordt ontbonden, er komen vervroegde verkiezingen

Als de Koning het ontslag van de regering aanvaardt én een meerderheid van Kamerleden stemt voor de ontbinding van de Kamer, dan moeten binnen 40 dagen parlementsverkiezingen gehouden worden. Binnen twee maanden moet de nieuwe Kamer van Volksvertegenwoordigers bijeen worden geroepen (art. 46 Grondwet).

In de periode tussen het ontslag van de oude regering en de benoeming van de nieuwe, blijft de oude regering aan in “lopende zaken”.

Waarschijnlijkheidsgraad: Nogmaals moeilijk in te schatten. Dit betekent dat de kiezers begin volgend jaar moeten gaan stemmen en enkele maanden later nog eens voor de Vlaamse en de Europese verkiezingen. Mogelijk willen politici stem-moeheid bij kiezers vermijden.

Le 10 mai dernier, Emmanuel Macron recevait le prix Charlemagne des mains de la chancelière allemande, Angela Merkel « récompensant sa vision forte pour l’Europe » et son engagement pro-Européen, à contre-courant de l’euroscepticisme ambiant qui s’installe dans l’Union. A l’issue de cette remise de prix, le président français a rappelé sa vision de l’Europe. Ce discours, comme celui prononcé à la Pnyx, à la Sorbonne et au Parlement européen, se basait sur quatre « convictions » comme quatre « commandements » : « ne soyons pas faibles », « ne nous divisons pas», « n’ayons pas peur », « n’attendons pas », a exhorté le président français qui cherche à s’imposer comme le leader fort d’une Europe unie et démocratique.

Et selon Emmanuel Macron, l’avenir de l’Europe passe par la voix des citoyens. Dans son discours à Athènes en septembre dernier, le président français estimait qu’au sein de l’Union européenne, la souveraineté, la démocratie, la confiance était en danger. Il avait alors proposé d’organiser des consultations démocratiques dans tous les pays européens en amont des élections européennes de mai 2019 – c’était aussi une de ses promesses lors de la campagne présidentielle début 2017. Le 17 avril dernier, il lançait en France la première « consultation citoyenne » – l’occasion pour les Français de s’exprimer pendant 6 mois sur ce qu’ils attendent de l’Europe – initiative dupliquée dans tous les pays de l’Union. Les conclusions de ces consultations seront ensuite débattues entre chefs d’état et de gouvernement lors du Conseil européen programmé au mois de décembre 2018.

Le président français est apprécié dans les cercles bruxellois pour son ardeur à défendre l’Europe mais aussi pour son charme et sa capacité à enthousiasmer les citoyens de l’Union. Mais plusieurs critiques se font déjà entendre. Certains pays l’accusent de défendre avant tout les intérêts de la France en Europe. Emmanuel Macron ne s’en cache pas : s’il croit très fortement en une Europe souveraine, il est aussi convaincu que pour redonner une place à la France – ce pourquoi il a été élu –  il a besoin d’une Europe forte. Mais seul face à une montée du populisme, ses chances sont minces d’y arriver. Alors saura-t-il mobiliser ses homologues et les citoyens européens suffisamment pour redresser le cap de l’Union d’ici la fin de son mandat ?

Un début d’été mouvementé pour la politique belge francophone. En effet, le Parti du Centre Démocrate Humaniste (cdH – anciennement Parti Social-Chrétien) a annoncé son retrait de la majorité gouvernementale en Wallonie et à Bruxelles, ne désirant plus gouverner avec le Parti Socialiste (PS).

Les raisons de cette annonce sont les scandales successifs qui ont ébranlés le PS ces derniers mois, mettant en doute le respect de la bonne gouvernance des Socialistes au pouvoir. Benoit Lutgen, chef de parti du cdH, a négocié, avec succès, avec les partis wallons de l’opposition pour mettre fin à la crise politique en Wallonie.

Le PS y avait gouverné pendant 30 ans sans interruption.

Les négociations ont abouti à un accord avec le Mouvement Réformateur (MR – parti libéral).

Les nouveaux ministres wallons libéraux, remplaçant le PS, ont récemment été nommés. Casting sans surprise, le gouvernement est composé de ministres expérimentés, sans représentant de grandes villes wallonnes et majoritairement de « quinquas » (le plus jeune des ministres ayant 48 ans).

Le vote de confiance accordé par le parlement wallon aux ministres était serré. Parmi les 75 parlementaires, aucune des 38 voix ne pouvait manquer à l’appel pour mettre en place le nouveau gouvernement.

Deux grossesses de parlementaires wallonnes, arrivant bientot à terme, ont d’ailleurs donné des sueurs froides aux négociateurs du cdH et du MR. Cette majorité faible pourrait néanmoins freiner considérablement la prise de décision dans le futur.

Les priorités du nouveau gouvernement commentées dans la déclaration de la politique régionale « La Wallonie plus forte » sont axées sur la transparence, la participation, la responsabilité et la performance.

Dimanche 7 Mai 2017, Emmanuel Macron a gagné l’élection présidentielle avec une majorité confortable (66,06%) face à son adversaire Marine Le Pen (33,94%), candidate du Front National. Bien que cette élection ait résonné à travers l’Europe et jusqu’en Outre Atlantique, elle a été marquée par une participation assez faible de 74,62% au second tour. Depuis hier, Emmanuel Macron entame une semaine cruciale aux côtés du président sortant, François Hollande, jusqu’à la cérémonie de passation des pouvoirs qui aura lieu dimanche prochain.

Les quatre points à retenir de la victoire du jeune politicien français :

1 – L’Europe, un point central de son programme

La persistance des problèmes économiques et industriels en France, de même que la montée du Front National, ont fait de cette campagne 2017 un véritable référendum sur l’Europe et la mondialisation. Face aux critiques acharnées de Marine Le Pen à l’encontre de L’Union Européenne, Macron a su affirmer ses valeurs et projets réformateurs pour redynamiser l’élan européen, et ce en mettant l’accent sur l’unité plutôt que le repli identitaire. De par ses fortes convictions européennes, le président élu a à la fois ravi et redonné confiance aux leaders européens.

2 – Le recul de l’extrême droite, mais un populisme bel et bien vivant

Bien que la défaite de Marine Le Pen soit réelle, le Front National a tout de même progressé de façon conséquente depuis l’élection présidentielle de 2012. Une fois de plus, les Français ont montré leur refus de voir arriver au pouvoir de la France, le Front National, aujourd’hui incarné par Marine Le Pen et anciennement mené par son père Jean-Marie Le Pen, dont l’extrémisme avait déjà été freiné par un front républicain au second tour de l’élection présidentielle de 2002. En revanche, le populisme persiste et cela se démontre également par la montée de l’extrême gauche, dont les résultats ont été historiques au premier tour. Le responsable du parti, Jean-Luc Mélenchon, a rappelé au lendemain des élections que le nouveau président Macron n’a pas été élu par un vote d’adhésion.  Ainsi, les revendications faites par les électeurs dénonçant les conséquences « de la mondialisation » déterminera la capacité de Macron à régir et à réformer efficacement le marché du travail.

3 – La République en Marche vers les élections législatives

L’énergie de Macron doit à présent se concentrer sur l’obtention d’une majorité absolue à l’Assemblée Nationale lors des prochaines élections législatives les 11 et 18 juin 2017. Bien que Macron souhaite qu’une large majorité de ses députés incarne le renouvellement par leur adhésion à son parti « En Marche ! ». Il espère tout de même bénéficier du soutien des politiciens du parti socialiste et du parti conservateur, les Républicains. Par ailleurs, certains ont déjà exprimé leur soutien et intérêt, sachant qu’il ne leur est pas demandé de quitter leur parti d’origine. Le Pen a déclaré dimanche soir qu’elle souhaitait s’imposer en tant que la « réelle force d’opposition » à Macron, malgré qu’il soit peu probable qu’elle parvienne à rassembler de nombreux députés, compte tenu des réalités du système électoral à deux tours.

4 – Réformiste ou guérisseur?

Macron semble capable de pouvoir faire face aux problèmes économiques et sociaux de la France de par son programme réformateur et ambitieux. Cependant, s’il souhaite éviter une opposition paralysante, marquée par des grèves et manifestations ayant bloqué les tentatives de réformes antérieures, un certain nombre de compromis devront être pris en considération. Dans son discours de victoire, il a exprimé dimanche soir aux sympathisants, devant le Palais du Louvre, qu’« une majorité votant pour le changement » l’avait élu président, avant d’avoir reconnu que « ce ne sera pas facile tous les jours ».

Brussels, 14.09.2016 – Today the European Commission unveiled a new legislative proposal to revise the bloc’s copyright framework. Foreseen (and repeatedly delayed) for a number of years, the revision was instigated by pressure on the Commission to make Europe’s copyright regime fit for the digital age and to address longstanding structural problems arising from an imbalance of rights and exemptions.

Leaked versions of the proposal imply a major lobbying victory for the European and American rightsholder industries. Indeed the proposal is set to fail in its stated aim to ‘modernise’ copyright for the digital age, as in the drafting stage there appears to have been a political pivot towards focusing on the protection of rightsholders in their commercial relationships with online platforms.

Many had seen this legislative reform as an opportunity to fix Europe’s broken exceptions and limitations regime, and perhaps even introduce a bold new copyright exemption for user-generated content. Notwithstanding progressive new copyright exceptions for text and data mining and uses of content for online educational purposes, the Commission’s proposal is likely to leave copyright modernisation proponents disappointed.

In today’s stakeholder reaction, the bulk of attention has been reserved for the provisions of the copyright reform proposal that concern the enforcement obligations of platforms vis-à-vis user-generated content and their accessory liability for hosting such content. The new obligations on platforms stem from the apparent ‘value-gap’, the allegation from rightsholders that they do not receive enough of the value derived from digital reproductions of their works.

Likewise, the Commission’s introduction of ancillary copyright for press publishers has been subject to much controversy, given the disastrous experiences with such ‘snippet taxes’ in Spain and Germany. Indeed, digital rights activists have accused the Commission of seeking to ‘break the Internet’ with the introduction of ancillary copyright for hyperlinks to press materials.

The legislative proposal must now be scrutinised and amended by the European Parliament and the EU Council (Member State representatives). A ferocious lobbying battle is expected in the Parliament, and it is likely that the text will be significantly altered before its final adoption.

After a two week break due to the Brussels attacks, the Belgian federal government reached a budget review agreement on Friday April 10^th. The federal government decided on half a dozen measures to fill the 2.2 billion euro gap. The proposed measures include creating a more attractive fiscal regime for peer-to-peer activities but with the obligation for online platforms in the sharing economy to collect tax revenues. According to the official numbers, such a measure is expected to increase the States’ tax income by €20 million.

Alexander De Croo, the Belgian Federal Minister for the Digital Agenda, proposed this plan to reduce administrative burdens on people using peer-to-peer services as a complementary activity and to promote the growth of the sharing economy. De Croo said: “Peer-to-peer economy is fully growing. People are offering more and more services, like car sharing and babysitting through apps and platforms but the current tax system is not ready for the reality of this new economy. Many people called for a simple and transparent system and that’s what we will introduce now.”

Currently peer-to-peer income is unclearly taxed and most people do not file their revenues from sharing economy at all. People who do file their revenues are taxed at a 33% rate which, according to Minister De Croo, is too high for these type of services. The new maximum income to qualify for the low tax rate is to be determined by government within a few weeks as well as the impact on social security.

The transmission of information on taxation will also be changed: platforms will be required to hand over income rates to the Belgian tax administration and the taxes will be collected from the source as it currently happens for employers and their employees. According to the Minister this will minimize the administrative burden for people that want to start a small peer-to-peer side business as there will be no need to register.

People using peer-to-peer platforms in a professional way, however, should register as self-employed, a measure with which the government wants to assure classic professionals face no unfair competition.

In light of the Brussels Digital Week (09-18 October), Political Intelligence organized a panel discussion on the sharing economy and its implications for Brussels on 14 October 2015. The private sector was represented by Car Amigo – Laurent Baeke and Peerby – Lieven D’Hont. Also part of the panel were Anne-Sofie Van de Velde, digital advisor to the Cabinet of Vice-Prime Minister De Croo and dr. Ingrid Molderez of the KU Leuven who provided an academic point of view.

A first point of discussion was the meaning of ‘sharing economy’. Participants agreed that one of the central elements is the fact that a person is no longer ‘owner’ but rather ‘user’, whereby the element of ‘durability’ becomes key. As people can be satisfied with less it might also have positive effects on the environment. At the same time some warned for the umbrella effect of the concept and that it can cover different realities.

All agreed that there is a need for changing the mentality of the society towards new economic models and did regret that very often media only reported on negative examples of sharing economy without relaying all the positive advantages that it entails.

Participants questioned why today EU companies were not as developed as US based companies. The panel warned for the risks related to overregulation. If the option of a too strong regulation for the mainly US based players is opted for, then these rules will also apply to the EU based players and new start-ups may face strong difficulties to survive. Instead of a climate of overregulation, an EU position on this topic and the application of a framework of general principles instead of fine regulations and criteria could offer a future proof framework. Important for the panel members is the role played by the Belgian federal level and political actors: there should be clarity in the regulations and rules that apply. At the same time, it was argued that rules already exist but that there might be need for more clarity.

Finally, the participants looked at the future relation between the traditional economy and the sharing economy. Hybrid economy will definitely emerge on the longer run. This will raise questions on how the traditional economy will need to adapt to digitalization amongst others. One of the aspect is that it is crucial to educate the younger generations and change the views of the older generations to embrace the new sharing economy.

After a short Q&A session with the public, attendees continued the discussion during a networking cocktail and both panel members and participants welcomed this interesting debate with a balanced view on sharing economy!

Les drones sont déjà utilisés dans certains Etats membres, généralement pour conduire des tâches impliquant normalement des coûts humains élevés. Leur efficacité est notamment démontrée dans l’inspection des infrastructures, des exploitations agricoles, la gestion  des catastrophes naturelles, mais aussi dans la prestation de certains services – à l’exemple d’Amazon l’an dernier avec son projet très médiatique de livraison par drones. Ainsi, certaines études ont montré que les drones pourraient faire croître l’économie européenne de 10 milliards d’euros dans les dix prochaines années, et créer plus de 150 000 emplois d’ici 2050. Alors que la Commission Juncker cherche à fonder son action en faveur de l’emploi et de la croissance, ces chiffres ne laissent personne indifférent au sein du Berlaymont.

Si les drones contrôlés au sol, ou selon la terminologie officielle, les systèmes d’aéronefs télépilotés (RPAS pour Remotely Piloted Aircraft System), sont légaux dans l’espace aérien européen, il n’existe toutefois pas de cadre réglementaire harmonisé permettant la reconnaissance mutuelle des licences de drones à travers l’ensemble des Etats membres. Plus inquiétant encore, il n’existe n’y a aucune garantie juridique claire quant à la sécurité et à la protection des données des opérateurs de drones et des citoyens.

Dans ce contexte, la Commission européenne a publié un mémo en avril 2014, esquissant son agenda législatif pour le secteur des drones. S’engageant à développer un « cadre pour l’intégration progressive des drones dans l’espace aérien civil à partir de 2016 », le plan de la Commission établit les ambitions de l’exécutif européen à travers cinq objectifs clés :

• Fixer des règles européennes strictes en matière de sécurité de l’exploitation ;
• Garantir la protection des droits fondamentaux des citoyens :
• Mettre en place des contrôles pour assurer la sûreté des exploitations de RPAS ;
• Garantir la responsabilité des tiers et l’assurance ;
• Soutenir le développement du marché et les entreprises européennes.

A cours des douze derniers mois, des représentants de la Commission ont dévoilé certains aspects d’une proposition de législation sur les drones. En parallèle, le comité des Transports du Parlement européen a initié un rapport sur le sujet, qui va sans doute nourrir la réflexion de la Commission. Il a été récemment annoncé que le rapport du Parlement, supervisé par la députée Jacqueline Foster (Royaume-Uni, Conservateurs et Réformistes), sera discuté les 15 et 16 juin prochains. Cette première version donnera un aperçu essentiel sur les intentions du Parlement, et fournira davantage de précisions sur toute prochaine action législative entreprise par l’Union européenne en la matière.

D’après le calendrier annoncé, le Parlement devrait finaliser sa position d’ici octobre cette année, après quoi la Commission publiera sa proposition d’acte législatif. Avec le battage médiatique autour du potentiel d’innovation et de croissance des drones civils, le rapport du Parlement européen devrait susciter de fortes attentes parmi les nombreux intervenants du secteur.

Lurking in the shadow of TTIP and bypassing the dead-locked Doha WTO Round, the TiSA (short for Trade in Services Agreement) trade deal is ramping up towards its 11^th round of negotiations this February. 

Currently being negotiated between 23 members of the WTO, including the European Union and the US, TiSA is looking to open up negotiating partners’ services markets. This would make it easier for businesses to offer their services in other countries, which – in the view of the European Commission – should lead to growth, jobs, lower prices and more choice for consumers/businesses. 

The topics on the table are areas already covered by the WTO General Agreement on Trade in Services (GATS), and will include telecoms, e-commerce, postal services, financial services, and road and air transport. Each country controls how far it opens up its market as they all make a tailored commitment based on the way their market is structured, the sectors it wishes to shield from foreign competition and the level of economic development. A sort of liberalization à la carte, if you wish, where every state negotiates its own terms and conditions.

MEP Viviane Reding, (ex-Vice-President of the European Commission for Justice, Fundamental Rights and Citizenship) is rapporteur for the TiSA file and sees possibilities for international standards to be created in the interest of European companies: “the aim is really to export European standards, not to abolish them.” The deal should secure agreements for European citizens, such as lower roaming charges on non-EU trips, more passenger rights and online consumer protection.

Given the astonishing attention TTIP (the Transatlantic Trade and Investment Partnership, a potential free trade deal between the EU and US) is getting in and around the EU-bubble, TiSA seems to be progressing somewhat under the radar. As several sensitive topics such as intellectual property rights, dispute settlement mechanisms, audiovisual policy, public provision of education and health are excluded, the attention tends to remain low for the moment.

However, the European Parliament hopes to issue a report on the development of the negotiations in the fall of 2015. Moreover, as the agreement does touch upon data flows – a sensitive topic due to its close connection with data protection – opponents could link the TTIP and TiSA trade deals in their criticism. So in the coming months we might expect more attention to be paid to the TiSA talks and future negotiations. The fact that a recent petition to stop TiSA has been signed online by nearly 300.000 people could in this respect be seen as a bad omen.
